Key EPA Rule-makings

Clean Power Plan (CPP) On 10/16/17, EPA proposed a repeal of the CPP. Public listening sessions were held on 2/21/18, 2/27/18, and 3/27/18. Comment period ended 4/26/18. Repealing the CPP
EPA Mercury and Air Toxics Standard (MATS) On 4/18/17, EPA requested that the DC circuit hold the litigation and the supplemental finding in abeyance, and that oral arguments be continued indefinitely. On 4/27/17, the court granted the motion, with a requirement that status reports be filed every 90 days. No further rulemakings or annoucements have been made. MATS
Ozone NAAQS On 11/16/17, EPA announced 2650 areas of compliance (85% of counties) with 0 nonattainment areas. On 4/30/18 EPA announced all remaining designations, except 8 Texas counties. 51 areas were in nonattainment, to varying degrees, starting a clock for them to reach compliance depending on the severity of nonattainment. Cross State Air Pollution Rule (CSAPR) Update rule (finalized September 2016)—litigation held in abeyance, but rule implementation is ongoing. Several States have sued EPA for failure to act on their section 126 petitions, including Maryland, Connecticut, and Delaware. On 4/9/2018, EPA issued a notice of final action rejecting Connecticuts 126 petition. CSAPR
Once in-always in On 1/25/18, EPA issued a memorandum weakening air pollution control technology requirements for Major Sources of hazardous air pollutants (HAPs) if those sources commit to limiting emissions to less than 10 tons per year of any 1 HAP or 25 tons per year of any combination of HAPs, allowing reclassification of Major Sources. On 3/26/2018, a coalition of environmental groups sued EPA. On 4/10/2018, California sued EPA. Repeal of Once In, Always In Memo
Regional Haze On 1/17/18, EPA annouced it's decision to review certain aspects of the Final Rule promogulated in 2016. On 1/19/18, EPA filed a motion to hold the case in abeyance pending it's review of the final rule. On 1/30/18, the US District Court of Appeals for the DC Circuit granted EPA's motion to hold the case in abeyance. Regional Haze

PM NAAQS 2012 NAAQS revision to 12 ug/m3 upheld by D.C. Circuit. Implementation Rule released July 2016. 2015 PM NAAQS
Oil and Gas Methane Rule On 7/31/17, DC Circuit Court of Appeals ordered EPA to enforce leak detection and repair requirements immediately. On 3/12/18, EPA published a Final Amendment that allows leaks to go unrepaired during repairs or emergency shutdowns, citing potential service disruptions.
